MOBILE APP TERMS AND CONDITIONS (Fera)

Effective date: 28 April 2026

These Terms and Conditions (“Terms”) govern your access to and use of the Fera mobile application and related services (the “App” or “Services”) operated by ZEROTAG PTY LTD (ACN 663 455 169) (“ZeroTag”, “we”, “us”, “our”).

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. About the App
Fera is the mobile companion for ZeroTag. It helps users sign in, restore and manage account-based access to ZeroTags, continue into related ZeroTag web experiences, and use certain supporting account and NFC features.

2. Eligibility and Accounts

You must have the legal capacity to enter a binding agreement to use the App. If you are under 18, you must have permission from a parent or legal guardian, who is responsible for your use.
To access certain features, you may need an account. You agree to provide accurate, current information and keep it updated. You are responsible for keeping your login credentials secure and for all activity on your account.

3. Sign‑In Methods

The App supports Sign in with Apple and Sign in with Google. Use of those services is governed by their respective terms and privacy policies. ZeroTag is not responsible for the operation of third‑party sign‑in services.

4. User Content

You may provide or upload content through the App, including display names, profile photos, images, files, links, and other content associated with ZeroTag or related ZeroTag web experiences (“User Content”). You retain ownership of your User Content, but you grant ZeroTag a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and use that User Content solely to operate, maintain, improve, and provide the App and related ZeroTag services.

You are responsible for your User Content and for ensuring you have permission to share it. We may remove or restrict content that violates these Terms or applicable law.

5. Web Handoff

When you choose to continue from Fera to a ZeroTag web experience, we may use temporary authentication/session data and a redirect destination to sign you into the related ZeroTag web service. We use this only to complete the access you requested, maintain continuity between app and web, and protect account access. We retain temporary handoff data only for as long as needed to complete or expire the handoff.

6. Acceptable Use

You agree not to:

1. use the App for unlawful, fraudulent, or misleading purposes;
2. interfere with the App or its security features;
3. reverse engineer, decompile, or attempt to extract source code, except as permitted by law;
4. scrape, automate, or access the App in a manner that overloads or disrupts it;
5. impersonate others or misrepresent your affiliation;
6. post or share content that is illegal, harmful, or infringes others’ rights.

7. Intellectual Property

The App, Services, and all related materials (including trademarks, logos, text, graphics, and software) are owned by or licensed to ZeroTag and protected by law.
You receive a limited, non‑exclusive, non‑transferable, revocable license to use the App for personal, non‑commercial purposes in accordance with these Terms.

8. Privacy

Our handling of personal information is described in our Privacy Policy, available in the App’s Legal section. By using the App, you agree to that policy.

9. App Store Terms

If you download the App from Apple’s App Store or Google Play, you acknowledge that these Terms are between you and ZeroTag, not Apple or Google. Apple and Google are not responsible for the App or its content. To the extent permitted by law, Apple and Google are third‑party beneficiaries of these Terms.

10. Availability and Changes

We may update, modify, suspend, or discontinue all or part of the App at any time. We may also update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Continued use after changes means you accept the updated Terms.

11. Termination

We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the App. You may stop using the App at any time and delete your account (where the feature is available).

You may stop using the App at any time and may request deletion of your account through the App.

12. Disclaimers

To the extent permitted by law, the App and Services are provided “as is” and “as available.” We make no warranties that the App will be uninterrupted, error‑free, or free of harmful components, or that content will be accurate or reliable.

Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law (ACL) or other applicable laws that cannot be excluded. Where permitted, our liability for breach of a non‑excludable guarantee is limited (at our option) to supplying the Services again or paying the cost of having the Services supplied again.

13. Limitation of Liability

To the extent permitted by law, ZeroTag is not liable for any indirect, incidental, special, or consequential loss, loss of profits, data, goodwill, or business interruption arising out of or in connection with your use of the App, third‑party services, or any reliance on information provided.
Nothing in these Terms limits liability that cannot legally be limited.

14. Indemnity

You agree to indemnify and hold harmless ZeroTag, its directors, officers, employees, and agents from any claim, loss, or liability arising from your breach of these Terms or your misuse of the App.

15. Dispute Resolution

If a dispute arises, the parties will first attempt to resolve it in good faith through negotiation. If unresolved, either party may refer the dispute to mediation in Victoria, Australia, before commencing court proceedings (except for urgent injunctive relief).

16. Governing Law and Jurisdiction

These Terms are governed by the laws of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria, Australia.
